As author of the report and programme producer significantly distorted certain details and subjective, unverified opinion of journalists was based on essentially wrong facts, GYLA deems it necessary to make the following announcement.After the August 2008 conflict GYLA filed 55 complaints on behalf of more than 350 victims to the European Court of Human Rights (ECHR). GYLA based its case selection criteria on the scope of human rights violations and presence of evidence corroborating the violation, but by no means on victim’s nationality. GYLA deems discrimination of people based on ethnic origin or any other distinctions unacceptable human rights protection without discrimination is the founding principle of our work.

The monitoring was implemented in frames of the Coalition “Transparent Foreign Aid to Georgia”, with support of Open Society Institute and Open Society-Georgia Foundation. Implementation of Vaziani Gombori-Telavi road construction and rehabilitation project started in 2009. Works performed by now were funded from the State budget, while main portion of the project will be funded from resources provided by the World Bank as a loan.GYLA monitoring aimed to examine legitimacy of state procurement process, control rational spending of financial resources, prevent identified violations of law, and to furnish society with information.

This means that any natural or legal person can submit written observations to the Constitutional Court regarding any specific case.Georgian Young Lawyers’ Association (GYLA) was the first to utilize the noted opportunity. On November 26, 2009 GYLA presented its written observations regarding constitutional lawsuit filed by the Public Defender against the Parliament of Georgia. The written observations were also forwarded to both the defendant and the plaintiff.

Under Article 25 of the Constitution of Georgia, “everyone, except members of the armed forces and Ministry of Internal Affairs, has the right to public assembly without arms either indoors or outdoors without prior permission. The necessity of prior notification of the authorities may be established by law in the case where a public assembly or manifestation is held on a public thoroughfare”.As media outlets have reported, the City Council of Tbilisi rejected notification of rally organizers, declaring that “on St. George’s day religious and civil festivities will be held in Tbilisi, in front of the Parliament and outside Kashueti Church of St. George. The Westminster Consortium for Parliaments and Democracy has current parliamentary strengthening programs in five countries – Georgia, Ukraine, Lebanon, Uganda and Mozambique (www.wfd.org).The program aims at supporting performance of legislative, supervisory and representative functions of the parliament by strengthening their effectiveness. It includes strengthening capacity of the parliamentary staff to enable them to provide professional assistance to MPs. The program format incorporates trainings and seminars, business trips to the British Parliament, exchange visits for MPs, etc.
