GYLA’s statement about the so-called Cable Case of the high officials of the Defense Ministry

Georgian Young Lawyers’ Association (GYLA) welcomes the court ruling of June 5 about the high officials of the Defense Ministry involved in the so-called Cable Case. 

On June 5, 2015 the criminal board of Tbilisi City Court upheld the motion of the defense and considered inadmissible the main evidence (expert opinion) submitted by the prosecution. 
 
GYLA finds the court decision fair, legal and justified. Moreover, by considering the main evidence of the prosecution inadmissible, the court seriously questioned validity and reliability of the prosecution, which was pointed out by the defense from the moment of detention of high officials. 
 
GYLA represents interests of one of the detained high officials (Giorgi Lobzhanidze) of the Defense Ministry. GYLA believed and believes that high officials are innocent in the so-called Cable Case and evidences submitted in the case fail to prove the fact of committing illegal and criminal acts by them.
 
Further, GYLA considers that keeping defendants’ in arrest before making the final decision by the court is unjustified and unreasoned, since there is no absolute need of such conduct as required by the ECHR and the European Case Law. 
 
We believe that the Appellate Court will uphold the ruling of the city court.
