The legislation on administrative offences requires systematic revision

The Parliament of Georgia is reviewing a draft law on amendments to the Code of Administrative Offences, which was initiated by the Government of Georgia, in an accelerated manner. Together with other changes, the proposed draft law specifies the periods of administrative detention. In particular, it limits the period of administrative detention in a non-working time to 48 hours. As indicated in the explanatory note, this change was made necessary by practical problems related to the calculation of the detention period.

The Ruling Party’s Decision about the Election System is Unacceptable

On June 19, the ruling party unveiled its decision to keep the mixed election system for the 2020 parliamentary elections and to replace it with a fully proportional election system for the 2024 elections. In addition, according to representatives of the majority, the threshold for the 2020 elections will be reduced to 3% as a one-time initiative, while the decision about the abolishment of party blocks (electoral coalitions) will remain intact.

Abolition of authorization of Shahin School-Lyceum is unsubstantiated

The Georgian Young Lawyers’ Association (GYLA) is responding to the 3 February 2017 decision of the Authorization Council for General Education Institutions which abolished the authorization of Shahin School-Lyceum LLC [1]. The GYLA believes that the decision to abolish the school’s authorization during the learning process fails to comply with the standard of substantiation and that the Authorization Council for General Education Institutions made a clearly inappropriate and disproportional decision, which resulted in unsubstantiated restriction of education, work, and personal development of a group of persons (students, teachers, representatives of the school administration).

Parliament Must Consider All Recommendations of the Venice Commission

On June 16, 2017, the Venice Commission will approve its final opinion about the draft of amendments to the Constitution of Georgia. The Chair of the Parliament of Georgia has reiterated on numerous occasions that the government is ready to consider all recommendations of the Venice Commission; however, following release of preliminary opinion of the Commission on the draft amendments, the chair of parliament and individual MPs from the parliamentary majority have stated that they don’t share some recommendations of the Commission.

NGOs Respond to the Process of Electing Four Members of the High Council of Justice in the Parliament of Georgia

The Parliament of Georgia is reviewing the issue of electing four members of the High Council of Justice of Georgia (HCOJ). On June 6, 2017, at the meeting of the Legal Issues Committee, the Council listened to 29 candidates. Representatives of non-governmental organizations monitored the committee's work and are submitting to the society the evaluation of the selection of the members of the Council by the Committee.

Georgian CSOs Address the Venice Commission

Georgian civil society organizations have issued a joint assessment of the work of the State Constitutional Commission of Georgia.  The document reflects the views of the International Society for Fair Elections and Democracy (ISFED), Georgian Young Lawyers’ Association (GYLA), Transparency International – Georgia, and the Open Society Georgia – Foundation (OSGF).  These four organizations were members of the State Constitutional Commission of Georgia and together were represented in all four working groups of the Commission.

Legal opinion on the judgment of the Grand Chamber in the case of Rustavi 2

GYLA, as well as the other representatives of Georgian civil society, actively monitored and repeatedly responded regarding the Court dispute over the shares of the TV Company Rustavi 2. The organization has repeatedly pointed out those shortcomings and circumstances, detected during the Court proceedings and in parallel to the Court proceedings, which raised questions regarding the impartiality of the Court in this dispute. These circumstances also led to the unequivocal perception that there was the interest of the authorities in the outcome of the case.
