Government of Georgia recognized before ECtHR obstruction of journalists’ activities at the June 15, 2009 rally

 On April 12, 2010 GYLA applied to ECtHR on behalf of the applicants “Sudio Maestro”, journalists T.Laliashvili and S.Kapanadze and N. Inasaridze, member of the Political Party “the New Rights” (he carried out photo recording of the rally). On June 30, 2015 ECtHR rendered a judgment that was published on the web-page of the court on June 23, 2015  and the case “Studio Maestro and others vs. Georgia” has been removed from the list of pending cases.

The Coalition’s Opinion on the Revised Version of the Draft Law on the Prosecutor’s Office

The Ministry of Justice has recently revised the draft law on the Prosecutor’s Office based on the Venice Commission’s recommendations. It needs to be noted that the Venice Commission considered the Coalition’s opinion on this issue in its extensive comments and suggested to significantly revise the draft.  The opinion criticized several initiatives of the authors of the draft law .

STATEMENT OF THE COALITION REGARDING THE PRELIMINARY JOINT OPINION ON THE PROSECUTION REFORM

On 7 July 2015 Venice Commission, Consultative Council of European Prosecutors (CCPE) and OSCE Office for Democratic Institutions and Human Rights (OSCE/ODIHR) issued a preliminary joint opinion on the draft amendments to the Law on Prosecutor’s office of Georgia. Prior to the issuance of the opinion, the Coalition for Independent and Transparent Judiciary had evaluated the draft amendments reforming the prosecution system that were proposed by the Ministry of Justice and supported by the Government of Georgia. Additionally, the Coalition had the opportunity to present its detailed opinion on the prosecution reform to the Venice Commission.

GYLA Held the Presentation of the Research “Sakdrisi-Kachaghiani – Destruction in the Name of Law”

On July 15, 2015, the Georgian Young Lawyers’ Association (GYLA) presented the research to the public: “Sakdrisi-Kachaghiani – Destruction in the Name of Law”. The research conducted by GYLA revealed a number of important issues, namely:  On December 12, 2014, the Ministry of the Culture and Monument Protection of Georgia and the National Agency for Cultural Heritage Preservation have made total of 17 actions and 4 decisions regarding Sakdrisi-Kachaghiani oldest mine, in one day, in the extremely suspicious circumstances. As a result, on December 13, 2014, the ltd. “RMG Gold” has illegally exploded the Sakdrisi-Kachaghiani archaeological object.

GYLA condemns the fact of expanding the occupation line by Russian troops and calls on the state government for implementation of all possible effective measures

Georgian Young Lawyers’ Association voices its position about expansion of occupation line by Russian Federation on the territory controlled by Georgia. According to the information released by media, on July 11, 2015 Russian troops pushed on the occupation line by 300 meters in village Orchosani Gori region, and by half and a kilometer in Tsitelubani-Khurvaleti area. Part of Baku-Supsa pipeline was also left behind the territory controlled by Georgia.

NGOs call on government to undertake real reform of law enforcement system

Excessive concentration of power in the Ministry of Internal Affairs (MIA) has always been subject to criticism. A comprehensive reform and depoliticizing of the Ministry was one of the election promises of the Georgian Dream. In the beginning of 2015, Irakli Garibashvili, the Prime Minister, announced a start of the reform of the MIA. As part of the reform, the government proposed a draft law on State Security Service which also envisaged amendments to up to 50 other laws. The bill, together with its applicable amendments, was adopted by the Parliament after the third reading on 8 July.

Evaluation of the Report about Implementation of the 2014 Action Plan of the National Human Rights Protection Strategy

 On June 9, 2015 Georgian Young Lawyers’ Association arranged a round table about evaluation of the report on implementation of the 2014 action plan of the National Human Rights Protection Strategy. GYLA’s report revealed the following: Ø Activities of the Interagency Coordination Council of the Georgia’s Human Rights Protection Government Action Plan were carried out with irregularities; - Activities of the working groups set up within the Council fail to meet the stated goal. Further, group members are involved in the process mostly for show; - Some gaps were observed in terms of activities envisaged by the Human Rights Protection action plan and adequate indicators; - In some cases it is difficult to find a link between certain activities and selected indicators, whereas progress oriented indicators aiming to measure achieved success are almost missing from the plan, which complicates evaluation of report implementation.
