On December 6, 2019, at 13:00 Tbilisi Court of Appeal will announce the decision on the case of Tbilisi Aviation Factory. The Court of Appeals has heard the case for two years.
The dispute concerns the compulsion of the owners of the Tbilisi aviation factory due to the pressure exerted by the agreed action of the state bodies in 2010 to yield for free Tbilisi Aviation Factory to the state that was previously acquired for 67 million USD. The persons actively involved in the forced process are also implicated in other state-seized property cases where their liability has been disclosed by the state.
The Court of Appeal must evaluate the decision made by the Tbilisi City Court on the case, which substantially contradicts the practice established by the Supreme Court of Georgia on similar cases.
Till today in all cases heard the Supreme Court of Georgia, in which a natural person is accused of forcibly confiscating property, the court decides to return the property to the rightful owner. Contrary to established practice, the Tbilisi City Court found in the case of Tbilisi Aircraft Manufacturing that the State was not required to prove its good conscience in making such deals, which is a very dangerous legal precedent.
